When you visit hearnm.org or send us an email, you are engaging with us through electronic means. By doing so, you consent to receive electronic communications from Hear New Mexico. We may reach you by email or by posting information directly on this website. You acknowledge that electronic communications fulfill any legal requirement for written correspondence.
Note: Any mobile opt-in data you provide will never be sold or shared with third parties for their own marketing purposes.
Phone (Voice & Text Messages)
By submitting a web form, contacting us for support, requesting an appointment, or otherwise reaching out to us, you consent to receiving text messages from Hear New Mexico. You acknowledge that these electronic communications satisfy any applicable legal writing requirement. You may opt out of text messages at any time by replying STOP.
SMS Marketing Disclosure
When you provide your phone number and choose to receive SMS messages from Hear New Mexico, you agree to receive recurring texts related to your relationship with us. These messages may include:
- Appointment confirmations and scheduling reminders
- Service updates and follow-up information
- Responses to your inquiries or support requests
- Occasional promotional offers and news about our hearing health services
Message Frequency: Frequency varies based on your activity with us. Promotional messages will not exceed 4 per month. You may receive additional messages in direct response to your requests or appointment activity.
Message & Data Rates: Standard message and data rates may apply depending on your mobile carrier and plan.
Opting Out: Reply STOP to any message at any time to unsubscribe. You will receive one final confirmation and will not receive further messages unless you choose to opt back in.

To the fullest extent allowed by applicable law, the total liability of Hear New Mexico and its affiliates under these Terms shall not exceed the amount you have paid through the Service, or $100.00 USD if no payment has been made.
Under no circumstances shall Hear New Mexico be liable for indirect, incidental, special, or consequential damages, including but not limited to lost profits, data loss, business interruption, personal injury, or privacy-related harm arising from your use of or inability to use the Service, even if we have been informed of the potential for such damages.
Some states may not permit these limitations, in which case liability will be restricted to the maximum extent allowed under applicable law.
"As Is" and "As Available" Disclaimer
